Private limited company under Belgium law HIND RABII, headquartered at rue Bronde, 2 à 4801 STEMBERT, registered in the CBE under n° 0875.284.745 (hereinafter known as "H.R.") offers, under the terms of use outlined in the present legal information (hereinafter "Legal Information"), web services consisting of a website, including an e-shop, accessible via the website www.hindrabii.eu, as well as a Facebook page "https://www.facebook.com/Hind-Rabii-Exclusive-Light-Design-172465079455541/" and a twitter account https://twitter.com/hind_rabii" (hereinafter "Web Services").

The website www.hindrabii.net is hosted by  OVH , who is also in charge of its technical maintenance and that of the mobile application. 

2.Champ d’application

The present terms of use describe the conditions under which H.R. authorises access and use of H.R.'s Web Services. 

They are applicable to anyone (hereinafter the "User"), who uses the Web Services for whatsoever reason. They are complemented by our Privacy Policy . Furthermore, online purchases are subject to our general terms and conditions for online sales. 

These terms of use contain important legal information relating to access, entry and use of Web Services. Please read these terms of use carefully before using H.R.'s Web Services. 

By accessing the Web Services, via any medium and for any reason whatsoever, you acknowledge having read and accepted these terms of use and unreservedly accept their content, In the event you do not agree with the content of our terms, you are requested not to use our Web Services.

3. H.R. Liability

1.1. The use of Web Services and information made available by H.R., within the context of Web Services is the full responsibility of the User. 
1.2. H.R. takes the utmost care of the quality of its Web Services. 
H.R. makes every effort to provide accurate and up-to-date information and to correct any errors in the shortest possible time, from the time these errors are brought to their attention. 

However, H.R. cannot guarantee its Web Services to be accessible and free from errors at all times and under all circumstances. Therefore, H.R. cannot be held responsible for any damage or inconvenience sustained by the User which may be incurred as a result of incorrect, inaccurate or missing information or a lack of clarity in the information provided by H.R. via their Web Services, nor for any information provided by third parties related to Web Services, for example on a third-party website to which it provides a link.

3.3  H.R. takes the utmost care of the quality of its Web Services. 
H.R. makes every effort to provide accurate and up-to-date information and to correct any errors in the shortest possible time, from the time these errors are brought to their attention.

3.4  H.R. shall not be held responsible for hyperlinks which are available on the websites of third parties and which redirect to the Web Services offered by H.R., nor for the content of these websites which is not reviewed or endorsed by H.R.

3.5  Furthermore, the User accepts that the download of information via the Web Services and the use of such information is their own responsibility. He/she is solely responsible for any possible damage to their computer and the possible loss of data which may result from the download or use of this information.

3.6  H.R. is not responsible for any direct or indirect damage caused by the transmission of viruses during the use of the Web Services, despite existing security measures being in place. H.R. accepts no responsibility for this, particularly if the transmission of the virus is caused by communication disturbances or connection problems, unauthorised access to the website by a third party and any resulting consequences or as a result of a force majeure.

Furthermore, the User assumes full responsibility for the adequate protection of his/her computer equipment and for taking the necessary steps to protect and backup data stored on it.

3.7  Users are responsible for any possible damage caused to other users or third parties as a result of their use of the Web Services. Except in the case of gross or intentional negligence or misconduct on their part, H.R. cannot be held responsible for any direct or indirect damage of any kind (including the loss of profits, the costs for acquiring an equivalent service or product or the loss of opportunities) incurred by the User or by third parties, caused by another User resulting from the use of the Web Services or the impossibility to use them, for whatever reason.

3.8  In any event, H.R. assumes no responsibility for unforeseen or indirect damage including the loss of profits, reputation, expected savings, clients or data.

4. Terms of access and use of Web Services 

4.1 The User agrees to:
use the Web Services in accordance with the law, the provision of the present Legal Information, the H.R. Privacy Policy, and where applicable, with H.R.'s general E-shopping/E-ticketing terms and conditions; use the Web Services in a responsible manner; 

guarantee the accuracy and truthfulness of all information communicated during the use of the Web Services; he/she also agrees to provide any updated information;

not make or try to make modifications to the information and services offered by H.R.as part of their Web Services, without prior agreement from H.R. and in particular, not to input data, of any kind, in the different types of media used by H.R. to provide the Web Services, such as other websites, applications, logos, photos or other data, nor create hyperlinks or links to other websites or applications without the express prior written consent of H.R.

refrain from all acts which directly or indirectly cause the malfunction or unavailability (temporary or permanent) of the Web Services.

refrain from reproducing or disclosing, without authorisation from H.R., via any medium whatsoever, all or part of the content communicated by H.R. via their Web Services as well as the Web Services themselves; 

compensate H.R. and/or third parties for damage sustained from the unlawful or abusive use of the Web Services, not in compliance with the present Legal Information.


4.2  Furthermore, in the event of non-compliance with the law by the User, the present Legal Information, the general conditions of sale or Privacy Policy, H.R. is entitled to suspend or cancel the User's access to the Web Services, without prior notification and without prejudice to any other claims.


5. Intellectual property rights


5.1 The User hereby accepts that H.R. is the sole owner of all the intellectual property rights related directly or indirectly to the Web Services and to information provided by H.R. via the Web Services and, in particular, to all its elements, including, but not limited to, the structure of databases, their content, logos, texts, images, sounds, and trademarks contained within them or even the interfaces, layout and computer programmes which the Web Services rely on. 
The User agrees to refrain from any action, direct or indirect, which may challenge the validity of H.R.'s intellectual property rights or affect the enjoyment of these rights by H.R.

No rights whatsoever shall be assigned or conceded to the User as a result of their access to or use of the Web Services. 

Any reproduction, in whole or part, communication, extraction and/or re-utilisation of the whole or even a small amount of the information provided via the Web Services or the Web Services themselves, or any of their components, in any form or medium, is strictly prohibited without prior written authorisation from H.R. The same goes for any adaptation, modification, incorporation, translation or marketing, in part or in whole, by any process in any medium, of the Web Services and their components including the present Legal Information, H.R.'s general conditions of sale and Privacy Policy.

The User is only authorised to access the Web Services, view their content and utilise them in accordance with the present Legal Information, H.R.'s general conditions of sale, competition rules and Privacy Policy. 


5.2  Furthermore, H.R. authorises the creation of surface linking which directs users to the Web Services home page or an internal page, to the exclusion of all other types of links. Consequently, H.R. prohibits, except with prior written agreement, any link or technological measure, such as deep linking, framing or in-lining which directly or indirectly reproduces all or part of the Web Services by diverting, altering or masking the source of the information or content or causes confusion surrounding the source of the information or content. 


5.3  The User grants H.R. the permanent, free-of-charge and irrevocable right to use all information, data, texts or images which the User communicates to H.R. as part of their use of the Web Services. This right of use applies worldwide.

6. Availability of Web Services

H.R. employs all reasonable means to ensure the security of its Web Services and their uninterrupted availability, seven days a week and 24 hours a day, as well as limiting as far as possible any inconvenience caused by technical errors or malicious acts by third parties. 

The User exempts H.R. from any responsibility in the event of the non-availability of its Web Services, malfunctions, errors, bugs, incidents or problems of any kind which are the result of a malicious act by a third party or any use of the Web Services by the User and the information which is published or distributed by linked websites. 

H.R. may not prevent access to or the use of its Web Services, except when they are temporarily interrupted for technical reasons. Without prejudice to article 4, H.R. may interrupt, at any time and without prior notice, access to the site for maintenance purposes or updates. H.R. accepts no responsibility for any damage suffered as a result of such an interruption. 


7.  Modification of Web Services and terms of use

H.R. reserves the right to modify or remove, at any time and without prior warning, the information and rates they publish, in any medium whatsoever, as part of their provision of Web Services. 

The present Legal Information may also be updated as may the general conditions of sale and the Privacy Policy. All these terms and conditions apply to the User while they are using H.R.'s Web Services. H.R. shall inform the User of any modifications to these terms and conditions by mentioning the date of the last modification, and the last available version, on Web Services media.

The Legal Information, general conditions of sale and Privacy Policy applicable for the entire time the User is using the Web Services are, in any event, those which are made available when the User accesses the Web Services.

9. Miscellaneous 


9.1  The invalidity of one or more of the provisions of the present Legal Information does not affect the validity, applicability and compulsory nature of the other provisions. If one or more of the provisions are judged or declared to be invalid on the basis of a law, regulation or ruling by a competent court, the force or scope of other provisions shall remain intact. Any invalid provision shall be replaced by a new provision aimed at reproducing, as far as possible, the initial objectives of the invalid provision.

9.2   The use of H.R.'s Web Services, Legal Information, general conditions of sale and Privacy Policy are subject to Belgian law. The Belgian courts and tribunals in the judicial district of Liege shall be solely competent in any dispute regarding the creation, interpretation and execution of the present terms and conditions.
